The Nunavut Water Board ("NWB") has established this website, in part, to fulfill its obligation to create and maintain an electronic public registry as required under section 78 of the Nunavut Waters and Nunavut Surface Rights Tribunal Act and section 15 of the Nunavut Waters Regulation

Your acceptance of these Terms of Use is a condition to your access and use of the NWB website.  If you access or use this website, you accept and agree to comply with these Terms of Use.  

Privacy Notice

If you are providing information or a document to the NWB through this website that relates to one of the NWB’s public duties or responsibilities under the Nunavut Land Claims Agreement and the Nunavut Waters and Nunavut Surface Rights Tribunal Act, then you must understand that you have no expectation or right of privacy concerning that information or document.  If you include personal information in that information or document, then you are agreeing to that personal information being part of the public registry information on this website.

If you are providing information or a document to the NWB concerning a private matter, such as applying for employment with the NWB, then the NWB is committed to ensuring the privacy of your personal information.

All personal information (not included in the public registry information) collected by the NWB is governed by the Privacy Act.  This means that you will be informed of the purpose for which your personal information is being collected and how to exercise your right of access to that information.

Accuracy of Information

The public registry information on this website has been prepared and submitted by persons other than the NWB.  The NWB cannot and does not warrant that the public registry information on this website is current, accurate, complete or free of errors.  Persons accessing the public registry information provided on this website should not rely on it, and any reliance on the public registry information provided on this website is taken at the sole risk of the user.  Users of this website are advised to conduct their own due diligence.

No Liability

The NWB relies upon the protection against liability under section 31 of the Nunavut Waters and Nunavut Surface Rights Tribunal Act.  The NWB assumes no responsibility for errors or omissions in any of the public registry information contained on this website. The NWB specifically disclaims any express or implied warranties related to the use of this website and its contents.

Third-Party Social Media

The NWB’s use of social media serves as an extension of its presence on the Web. Social media account(s) are public and are not hosted on NWB servers. Users who choose to interact with us via social media should read the terms of service and privacy policies of these third-party service providers and those of any applications you use to access them. The NWB may use Twitter, Facebook, LinkedIn and/or YouTube.

Applicable Law

All users of this website agree that any information or document provided by the user for the public registry will not be defamatory, derogatory, disrespectful or in breach on any territorial or federal law.  All users of this website irrevocably submit to the exclusive jurisdiction of the Courts of the Territory of Nunavut in connection with any matter or dispute arising from the use of this website or its contents.

All users of this website irrevocably waive any defences or legal rights respecting conflict of laws, choice of law and forum non conveniens, which but for such waiver might otherwise apply, in any legal action commenced in the Territory of Nunavut as a result of any claim arising from the use of this website and its contents.

This website is operated by the NWB from its offices within the Territory of Nunavut, Canada. The terms and conditions upon which users may access and use the website are governed by the laws of Nunavut, the Nunavut Land Claims Agreement and the laws of Canada, applicable in Nunavut.

In no event shall the NWB be deemed to have submitted to the jurisdiction of any Court or tribunal outside of Nunavut as a result of any access to this website by anyone from any location outside Nunavut.
